RE LIST it....Do it...but Do a search on EVERY buyer that bids over 10K..you can do this on ebay and find out all the information on the bidder., You are going to get a lot more on the auction then on phone calls, you have to realize that the majority does NOT know how to contact you for this...

As for eBay, they have some crazy listing restrictions on listing the iPhone, and considering you have hacked it, I'm about 99% sure you won't be able to list it because of the hack. I can't find the policies with a quick search but I do remember reading them before and I'm pretty sure you won't be able to sell it on eBay.
However, I'd try other places such as Yahoo! Auctions or perhaps even Amazon.com.
As for these silly arrest theories, for what breach of contract? It's a breach of contract once you change carriers and AT&T charges around $150-$200 to terminate your contract early. Plus the phone might have been bought without a contract who knows. It doesn't matter because another phone could be used instead (e.g. parents' other phone using that SIM card).

The iPhone will only work on a GSM network. That would be T-Mobile or AT&T/Cingular/Suncom in the US. Sprint, Verizon, US Cellular, Alltel use a CDMA network.

All purchases are contracts, but that's not the contract I speak of, nor any of the service contracts you speak of. Go read the fine print on the iPhone package. There will be a ton of it and in it there will be "by opening and using this item you agree to not modify, reverse engineer, or otherwise open to alter for the purposes of financial gain..." and/or similar and more (selling the phone is "for the purposes of financial gain”). Trust me, there is language all over that device (which is totally binding) that will open him and his parents up to all kinds of financial liability. Hopefully the party or parties holding a cause of action just let it go, but they don't have to, and the last thing geohot needs is a bunch of uninformed half-assed legal advice on a blog. About 3 maybe 4 lawyers have posted here (including me), and I’m sure every single one of us would strongly advise Mr. Holtz get professional, confidential advice in real life (which he could get for free), and not rely on the posts here (whether written by a lawyer or one of the 10s of "common sense" lawyers who are trying to help). This is not a place to engage in a cynical commentary of our legal system (which I would gladly join), but there are real issues here, and Mr. Holtz will be fine, if he doesn’t just ignore the issues and “hope for the best.”

Just goes to show that people can be real jerkoffs. First, people always ruin a good auction on ebay, then ebay doesn't help you.

Not sure anyone's mentioned this, but when you do auction things like this, you can make it a Private auction, where only bidders you add to a list can bid, and no one can see who's bidding what amount. (Here's what the Bid Hist looks like on Private listings: http://offer.ebay.com/ws/eBayISAPI.dll?ViewBids&item=120152711419).
You can also make it a Pre-Approved Bidders auction, and bidders would have to contact you so you can research them (FB rec'd, FB left, 30-day bid hist, ask them questions, etc) before adding them to the list. This way you can avoid 99% of the jerks, game players, NPBs, and others who'd want to spoil things for you and legit bidders. This is common on high-profile/high-ticket items. (My husband also thinks some bids may have been from Apple employees [either on their own or on behalf of Apple] wanting to keep it from selling without actually pulling a VeRO on you.)

I was the lady who wrote to you through eBay giving you instructions on how to end your auction without incuring eBay fees. I see that you were able to end your auction with zero bids. Good for you!
Hopefully, eBay will not charge you anything other than the money associated with the 'insertion fee' you incurred when first listing your iPhone.
I'm just wondering though - today you show up NARU'd (Not A Registered User) on eBay. Why did eBay NARU you? That totally sucks.
eBay was probably loving all of the publicity associated with your auction - so, no wonder they were not cooperative in helping you end the auction. Plus, they were hoping for a big fat percentage of the price your iPhone would finally sell for. eBay is all about the dollar and is not known for being cooperative by helping people who are in dangerous financial situations on their auction site.
Live Help is worthless on eBay & eBay is just not a cooperative organization - so sorry you had this bad experience.
If I were you - I would call the credit card company of the card you have on file with eBay, tell them what happened, advise them that no charges are to be made on that card by eBay and then cancel the card (so eBay can't hit you up for any huge charges). Your credit card company will issue you a new card with a new number.
Your credit card company should be able to do that in a few short days - and then you will have the use of your card while in are starting college. You may have used your parents card or a friends card to open your 'seller account' on eBay - please do them a favor and tell them the situation & to act quickly.

I'm a law student, and I think that AT&T would have reasonable grounds to sue you, infact I feel that the next step by AT&T would be to block your hack, take you to court for breach of contract and then hope to fix the hack which you've created (which i think is awesome). You need to put in a small disclaimer somewhere on your blog which says that the hack is intended for educational/research purposes only, and that you do not advise anyone to go ahead with it, and then call a good lawyer; you need to build up your defense soon, you might be the only 17year old kid who's cost a company billions of dollars in lost revenue ;)

إني تذكـرت والذكرى مؤرقـة * مجـداً تلـيدا بأيـدينا أضعـناه
أنَّى اتجهتَ للإسـلام في بـلـدٍ * تجْده كالطيرِ مقصـوصًا جناحـاه
كـم صرفتنا يـدٌ كنـا نـصرفها * وبات يـملكنا شعب مـلكناه
بالله سل خلف بحر الروم عن عرب * بالأمس كانوا هنا واليوم قد تاهوا
وانزل دمشق وسائل صخر مسجدها * عمن بناه لعل الـصخر ينعـاه
هذى معـالم خرس كـل واحـدة * منهن قامت خطيبـا فاغرا فـاه
الله يعلم ما قلبت سـيرتهم يومـا * وأخطـأ دمـع الـعين مـجراه
يا من يرى عمـراتكسوه بردته * الزيت أدمٌ لـه والكـوخ مـأواه
يهتز كسـرى على كرسيه فرقـا * من خوفه ، وملوك الروم تخشـاه
يا رب فابعث لنا من مثلهم نفـرا * يشـيدون لـنا مـجدا أضعنـاه
